Record Source: at Middlesbrough Police Court the Chief Constable objected to some of the proposed jurors on the list submitted by the Assistant Overseer, Mr W. GOUNDRY, on the grounds that some of them were aliens, and alien enemies. The Jury Act of 1870 stipulated that an alien who had not been domiciled in the country for ten years was not qualified to serve on juries or inquests. The application was adjourned for a week so that the Chief Constable and Mr GOUNDRY could check off the names of aliens.

Record Source: when the jury list was again submitted at Middlesbrough on Friday week by Mr W. GOUNDRY, the assistant overseer, the Chief Constable (Mr Henry RICHES) applied that the names of a number of men be struck off on the ground that they were alien enemies. The Stipendiary said it was a difficult point to decide as the Act definitely stated that any alien who had been domiciled in the country for 10 years was entitled to be on the list. Nothing was said about alien enemies. Nevertheless, it was evident by the recent Orders in Council that the liberties of alien enemies should be restricted. It was scarcely equitable that these men should be on the list, and he would strike them off.

Correspondence was read showing that the Ministry of Health had been approached by the Corporation on the matter and had stated that the Minister's decision in favour of the claim was final. Solicitors intimated that they had been instructed by Mr. GOUNDRY to issue a writ against the Corporation - the Council decided to accept service of the writ and the Town Clerk was instructed to prepare a defence.
