This is the Last Will and Testament of me George NEWCOMBE of Heighington in the County of Durham, yeoman made this Eighth day of January in the year of our Lord one thousand eight hundred and forty nine. I give, devise and bequeath all my real and personal estate whatsoever and wheresoever unto my son William NEWCOMBE of West Auckland in the County of Durham, farmer and my friend Joseph BOOTH of the same place, joiner, their heirs and assigns upon trust to pay thereout all my just debts, funeral and testamentary expences and the expences of carrying the trusts of this my Will into effect and subject thereto I give and devise all that my messuages tenement or dwellinghouse situate in Heighington aforesaid wherein I now dwell unto my said son William NEWCOMBE his heirs and assigns for ever subject nevertheless to and charged and chargeable with the annual payment of one pound to my daughter Elizabeth HEUGHF for her life. I also give and devise unto my said daughter Elizabeth HEUGHF all my messuage or dwellinghouse adjoining Shepherds Inn in Heighington aforesaid and I likewise give and bequeath unto the said Elizabeth HEUGHF the legacy or sum of thirty pounds and I hereby direct my said trustees by and out of the rents interest or dividends arising out of my said real and personal estate and by application if necessary of the said principal sum of thirty pounds to pay to my said daughter Elizabeth HEUGHF the weekly sum of four shillings during her life and in case my said trustees shall deem it expedient I hereby empower them to sell or mortgage the said last mentioned dwellinghouse and premises and out of the money thereby raised to pay unto my said daughter during her life such weekly or other sum as they may think proper and in case there shall be any residue of the said monies and premises remaining in the hands of my said trustees then I give devise and bequeath such residue equally between and amongst the children of my said daughter their respective heirs and assigns to take as tenants in common. I give and bequeath unto my son Thomas NEWCOMB the legacy or sum of one hundred and thirty pounds, to my son George NEWCOMBE the legacy or sum of thirty pounds, to my son William NEWCOMBE the legacy or sum of thirty pounds and to my grandaughter Margaret HEUGHF the legacy or sum of twenty pounds and I hereby direct that the said four last mentioned legacies shall be paid at the end of twelve calendar months next after my decease and I give and bequeath unto my grandaughter Elizabeth NEWCOMBE daughter of my said son George NEWCOMBE, the sum of one hundred pounds to be paid to her on her attaining the age of twenty one years and I hereby direct my said trustees to apply the interest thereof and so much of the principal as they may deem requisite towards the maintenance education or bringing up of my said grandaughter Elizabeth NEWCOMBE until she attains that age and in case my said grandaughter shall die under the age of twenty one years and before all the above mentioned monies are expended then I give and bequeath all such residue unto my said son George NEWCOMBE his heirs and assigns and as to all the rest residue or remainder (if any) of my real and personal estate which shall remain after answering and satisfying the purposes hereinbefore expressed and declared of and concerning the same Upon Trust that they my said trustees do and shall pay and divide the same equally between and amongst my said sons Thomas NEWCOMBE, George NEWCOMBE and William NEWCOMBE and my said daughter Elizabeth HEUGHF their respective heirs and assigns share and share alike and to take as tenants in common and I declare that if the said William NEWCOMBE and Joseph BOOTH or either of them or any trustees or trustee to be appointed under this provision shall die or decline or become unwilling or unable to act as trustees or trustee of this my Will, it shall be lawful for the trustees or trustee for the time being whether continuing or declining to act, or if none for the executors or administrators of any deceased trustee by any writing under hand to appoint any fit person or persons to be a trustee or trustees in the place of any trustee or trustees dying or declining or becoming unwilling or unable to act and I declare that the receipt or receipts of my saidtrustees for the time being shall be sufficient discharges for all monies received by them which shall arise or become payable under the exercise or execution of any of the trusts in them reposed by this my will, and that such receipt or recipts shall exonerate the person or persons taking the same from all liability to see to the application of the money therein mentioned And I further declare that my said trustees shall not be answerable or accountable for each others acts or defaults nor for losses happening without their respective neglect or default and that they shall be at liberty to retain and allow to each other all expences incident to the execution of the trusts of this my will and I expressly direct that all trusts, powers, discretions, directions and indemnity in this my will contained and given to my trustees generally shall be construed and considered as given or having relation to any the trustees or any the sole trustee for the time being of this my will and that such trustees or trustee may exercise and act in such trusts powers discretions and directions and avail themselves and himself of such indemnity accordingly. I nominate, constitute and appoint the said William NEWCOMBE and Joseph BOOTH joint executors of this my will and I hereby revoke and make void all former wills by me at any time heretofore made and publish and declare this only to be my last Will and testament In Witness whereof I have to this my last Will and testament contained in three sheets of paper set my hand and seal (that is to say) my hand to the first two sheets thereof and my hand and seal to this third and last sheet the day and year first above written.

This is a Codicil to the Last Will and Testament of me George NEWCOMBE of Heighington in the County of Durham, yeoman bearing date the eighth day of January in the year of our Lord one thousand eight hundred and forty nine and which I desire may be considered as part of my said Will Whereas by my said will I gave and bequeathed all my personal estate and effects unto my son William NEWCOMBE of West Auckland in the County of Durham, farmer, and Joseph BOOTH of the same place, joiner, upon certain trusts in my said will mentioned. Now I do hereby revoke and make void the said bequest so far as regards any household furniture and do hereby give and bequeath the whole of the said household furniture, with the exception of a set of pewter plates and dishes and my Bible unto my grandaughter Margaret NEWBY the wife of William NEWBY, before her marriage called Margaret HEUGHF. But in case my said grandaughter Margaret NEWBY should happen to die during my lifetime then I give and bequeath the said household furniture unto my three sons William NEWCOMBE, Thomas NEWCOMBE and George NEWCOMBE equally to be divided amongst them share and share alike, and if any of my said sons should happen to die leaving lawful issue, then the child or children of him or them so dying to be entitled to their parent's share In Witness whereas I the said George NEWCOMBE have to this my codicil set my hand and seal this eighth day of May in the year of our Lord one thousand eight hundred and forty nine.

Appeared personally Thomas SHEPHERD of Heighington in the County of Durham, Grocer, and made oath That he is one of the subscribed witnesses to a codicil annexed to the last Will and Testament of George NEWCOMBE late of Heighington in the County of Durham, yeoman, deceased now hereunto annexed the said Will bearing date the eighth day of January one thousand eight hundred and forty nine and the said codicil bearing date the eighth day of May in the same year that the said Testator duly executed the said Codicil by making his mark thereto in the presence of this Deponent and James MACKIE and Henry CASS the other subscribed witnesses thereto who were present at the same time and this Deponent and the said James MACKIE and Henry CASS thereupon attested and subscribed the said codicil in the presence of the said Testator and of each other.
