Record Source: he was witness to a murder at Houghton-le-Spring. The victim's rooms were above those where GOUNDRY was lodging. The staircase from the upper rooms opened onto the front street, and a doorway from it which had been papered over opened onto GOUNDRY's kitchen, which opened onto the back street. Just before midnight he heard the sound of a blow, and a man ran through the papered-over door and out into the back street. The victim then followed, and died in the street, having been stabbed through the heart. The attacker was later identified as John McCANN, who admitted striking the victim when he had tried to take a knife from him while he was cutting some tobacco - the pair had spent the evening drinking.

Record Source: at his trial at Durham Assizes it was said that McCANN was of "imperfect education". One of the witnesses called was Thomas William GOUNDRY, but Mr. GRANGER (for the prosecution) "intimated that the man was so drunk that it was doubtful whether he could be put in the box. His Lordship said this was disgraceful. If the man came into the box in a drunken state, he would certainly send him to prison for contempt of court. The man was not asked to give evidence, and his expenses were disallowed". Later, "Mr. SKIDMORE intimated that he wished to cross-examine GOUNDRY for the defence, and his Lordship said he would take care that this drunken animal should be called during the day. After a short pause in the proceedings, William GOUNDRY, an elderly man, was called, and staggered into the witness-box. Asked by his Lordship what was the matter with him he made an unintelligible sound. His Lordship said he was quite satisfied now that the man was guilty of contempt of court and he would not let him be sworn". He was subsequently sent to prison for fourteen days, for contempt of court. After deliberating for only 20 minutes the jury found McCANN guilty of murder and he was sentenced to death, but later reprieved. A few months later McCANN died in Durham Gaol "from mania of a religious kind".
