Genealogy Event 13
Event Type: Custom Event
Event Date: 26 SEP 1859
Record Source: at Durham County Court an action of ejectment was brought by the Surveyor of Highways for the township of Sherburn against Henry OLIVER and his sister Hannah OLIVER, to recover possession of a piece of land known as "The Garth", occupied by them. On 9th November 1858 a parish meeting at Sherburn had resolved "That in order to carrying out the contemplated improvements of the road between the two railways, and widening the bridge over the burn, the tenants occupying the township road be served with notices to quit at the end of the current year of their tenancy". Henry OLIVER stated that he had helped his father to cultivate the garth until he (the witness) lost his leg 24 years ago. His father then gave him half of the garth, and he had possessed it ever since He had never paid a halfpenny rent for it, and was never asked for any. His father occupied the other half until his death in 1841, and the witness was his eldest son. His sister kept his father's house, and on their father's death the witness let the sister have the other half as she had to keep his brother, "who was not quite right". He never told her to pay any acknowledgement nor never heard of his father paying anything. . . . . . Hannah OLIVER said she had occupied half of the garth after her father's death by her brother's leave. Mr. GOUNDRY first asked her for rent for the garth. Her brother had no work so she paid Mr. GOUNDRY the rent he asked, because he promised to give her brother work. She did not mention the payment to Mr. GOUNDRY to her brother for some time, and he was very angry when she did. Her brother now had possession of the whole of the garth. His Honour said he would reserve his judgement until the 10th of October.
