JANE attains the Age of Twenty one years; to my said wife for and during and until my said Daughter CAROLINA JANE attains the age of Twenty one years, provided my said wife should not marry again then I give and devise my said Copyhold Dwelling Houses and Lands and premises at Byers Green aforesaid with their appurtenances unto my said Daughter CAROLINA JANE her heirs & equals? in right and assigns for ever, subject nevertheless as hereinbefore and hereinafter is mentioned and I do hereby charge my said Freehold Estate at Coundon aforesaid on my said son THOMAS attaining the age of Twenty one years with the payment of the sum of Five pounds a year to my said Wife for and during the time she remains my widow And I do hereby charge my said Copyhold Estatesat Byers Green on my said Daughter CAROLINA JANE attaining the age of twenty one years with the payment of the sum of Five pounds a year to my said wife for nd during the time she remains my Widow And immediately on my said Daughter CAROLINA JANE attaining the age of Twenty one years I give and devise the Dwelling house now occupied by me to my said Wife for and during the time she remains my Widow And I do hereby charge my Freehold Estate at Coundon with the payment of the sum of One hundred pounds to the child or children with which my Wife may be pregnant at the time of my decease And I also charge my Copyhold Estates at Byers Green aforesaid with the payment of the sum of One hundred pounds to the child or children my Wife may be so pregnant with, to be paid on he she or they attaining the age of Twenty one years the Interest of which several ???? I hereby direct shall be applied in the meantime towards their her or his maintenance and education And further upon Trust that on the death or marriage of my said Wife my said Trustees shall ???? do from time to time during the respective Ministries of my said children apply the Rents yields and profits of my said Freehold and Copyhold Estates for and towards their respective maintenance and education I give and bequeath to my said wife during the time she remains my Widow, after payment of all my just debts and funeral Expences , All my personal Estate and effects wheresoever and whatsoever and after her marriage or death I give and bequeath the same to my said children THOMAS, CAROLINA JANE and the child or children with which my Wife may be pregnant at the time of my decease equally to be divided between them share and share alike And I do hereby nominate constitute and appoint my said Wife MARY LAYTON during her Widowhood and the said DANIEL IVESON and JOHN FRIEND Executrix and Executors of this my last Will and hereby revoking all other and former Wills by me at any time heretofore I do declare this to be my last Will and Testament In Witness whereby I have hereunto set my hand and seal this day and year first before written

    Record Source: His freehold estate at Coundon was left in Trust to his son Thomas, on his attaining the age of 21, subject to £5 a year from the proceeds being paid to his widow Nancy, as long as she did not remarry. It was also charged with £100 to be paid to any child with whom Nancy was pregnant at the time of William's decease, on it or they reaching 21, the interest in the meantime to go towards their maintenance and education. His copyhold estate at Byers Green was left in Trust for daughter Carolina Jane, on her attaining the age of 21, subject to £5 a year from the proceeds being paid to his widow Nancy, as long as she did not remarry. William's house, which he lived in at Byers Green was left to Nancy, subject to her remaining his widow. On the death or re-marriage of his widow the interest, profits etc. from the Trusts were to be applied by the Trustees to the maintenance and education of his children. A copyhold house at Byers Green, then occupied by his mother Elizabeth LAYTON, was left to her for the rest of her life, when it was to go to Carolina Jane, her heirs and assigns.
